These Terms of Service ("Terms") govern your use of MTG Agents ("the Service"), operated by Florian Krempl ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Service Description

MTG Agents is an AI-powered assistant for Magic: The Gathering players. The Service provides:

• AI chat assistants for rules questions, deck building advice, and lore knowledge
• Deck management tools for creating, editing, and sharing decks
• Community features including public profiles and shared deck lists
• Voice input (Supporter feature) for hands-free interaction with AI assistants

The Service relies on artificial intelligence models that may produce inaccurate, incomplete, or outdated information. See Section 7 for important disclaimers about AI-generated content.

2. Account Terms

2.1 Eligibility

You must be at least 13 years old to create an account or use the Service. If you are under 18, you confirm that a parent or legal guardian has reviewed and consented to these Terms on your behalf.

2.2 Account Responsibilities

• You may only create one account per person
• You must provide accurate registration information
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity that occurs under your account
• Notify us immediately at [email protected] if you suspect unauthorized access

3. Acceptable Use

You agree not to:

• Submit abusive, harmful, threatening, or illegal content via chat, voice input, or any other feature
• Attempt to manipulate, exploit, or circumvent AI agent safeguards
• Scrape, crawl, or access the Service through automated means without permission
• Overload or interfere with the Service's infrastructure
• Impersonate another person or misrepresent your identity
• Upload content that infringes third-party intellectual property rights
• Use the Service for any purpose that violates applicable law

We reserve the right to suspend or terminate accounts that violate these rules (see Section 10).

4. Supporter Subscription

4.1 Benefits

The Supporter tier provides additional features such as voice input, extended chat capabilities, and other benefits as described on the Service at the time of purchase.

4.2 Payment

Supporter subscriptions are processed through Buy Me a Coffee. Payment terms, billing cycles, and accepted payment methods are governed by Buy Me a Coffee's terms of service.

4.3 Cancellation

You may cancel your Supporter subscription at any time through Buy Me a Coffee. Upon cancellation, you retain access to Supporter features until the end of your current billing period.

4.4 Refunds

Because the Supporter subscription grants immediate access to digital content and services, no refunds are provided once access has been granted. By subscribing, you acknowledge and consent to the immediate provision of digital content and waive your right of withdrawal under EU Directive 2011/83/EU (Article 16(m)).

4.5 Changes to Supporter Features

We may modify, add, or remove Supporter features over time. We will notify Supporters of material changes in advance via email or website notice.

5. Voice Input

If you use the voice input feature (available to Supporters):

• Your audio is processed by OpenAI (a third-party service) for speech-to-text transcription
• We do not store your audio recordings — audio is streamed to OpenAI and immediately discarded
• There is no guarantee of transcription accuracy
• You are responsible for the content of your speech — the same acceptable use rules (Section 3) apply
• Voice input is entirely optional; text input is always available as an alternative

6. User Content

6.1 Ownership

You retain ownership of content you create on the Service, including decks, deck descriptions, and chat messages.

6.2 License to Us

By creating content on the Service, you grant us a worldwide, non-exclusive, royalty-free license to store, display, and distribute that content as necessary to operate the Service (for example, displaying your public decks to other users).

6.3 Your Responsibility

You are responsible for ensuring that your content does not violate third-party rights or applicable law.

7. AI Disclaimer

AI responses are not professional advice. Specifically:

• AI-generated content is not official Magic: The Gathering rulings, legal advice, financial advice, or any other form of professional guidance
• AI models may produce incorrect, incomplete, or outdated information
• You should verify important information independently (e.g., check official MTG rules sources for tournament play)
• We are not responsible for decisions you make based on AI-generated responses

8. Intellectual Property

8.1 Our Content

The MTG Agents name, branding, website design, and original content are the property of the operator. You may not copy, modify, or redistribute our content without permission.

8.2 Magic: The Gathering

Magic: The Gathering, all card names, and related trademarks are property of Wizards of the Coast LLC. MTG Agents is an independent fan project and is not affiliated with, endorsed by, or sponsored by Wizards of the Coast.

8.3 Third-Party Content

Card data, images, and related content are sourced from public APIs (such as Scryfall) and are used in accordance with their respective terms.

9. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.

We do not guarantee:

• Continuous, uninterrupted, or error-free operation
• The accuracy or completeness of any AI-generated content
• The availability of third-party services we rely on (including AI model providers)

To the maximum extent permitted by applicable law, our total liability for any claims arising from your use of the Service is limited to the amount you have paid us (if any) in the 12 months preceding the claim. This limitation does not apply to liability that cannot be excluded under applicable law, including Austrian and EU consumer protection law.

10. Termination

10.1 By You

You may delete your account at any time. Data handling upon deletion is described in our Privacy Policy.

10.2 By Us

We may suspend or terminate your account if you violate these Terms. Where possible, we will provide notice and an opportunity to address the violation before termination.

10.3 Effect of Termination

Upon termination, your right to use the Service ends. Sections that by their nature should survive termination (including Sections 7, 8, 9, and 11) will continue to apply.

11. Governing Law and Disputes

• These Terms are governed by the laws of Austria
• The courts of Vienna, Austria have jurisdiction over any disputes arising from these Terms
• For EU consumers: You may also bring proceedings in the courts of your country of residence
• EU Online Dispute Resolution: You may use the European Commission's ODR platform at https://ec.europa.eu/consumers/odr

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes:

• We will update the "Last Updated" date below
• We will notify users via email or a prominent notice on the website
• Continued use of the Service after changes take effect constitutes acceptance of the updated Terms
• If you disagree with the changes, you may stop using the Service and delete your account
